Kituwah Energy sues Emmitt Smith over failed solar farm project

Kituwah Energy, a business entity owned by the Eastern Band of Cherokee Indians, filed a lawsuit in Delaware Chancery Court against former Dallas Cowboys star Emmitt Smith. The agency alleges that Smith and his business partner, David Mosley, defrauded the organization of $2.5 million intended for a Texas solar installation known as Project Exodus. The complaint asserts that the funds were diverted to Wilson Holdings instead of being used to secure land rights and financing for the development. Kituwah Energy claims the project never materialized and reports that the original loan remains unpaid, with the current debt totaling approximately $3.1 million including interest. Smith has previously been involved in litigation regarding alleged financial schemes, though he was the plaintiff in those prior cases. Requests for comment from the business entities involved in the current complaint were not returned.
